Suit for non-delivery-Section 57
Where the setter wrongfully neglects or refuses to deliver the goods to the buyer, the buyer may sue the setter for damages for non-delivery. The measure of damages will be:
a. when there is an available market for the goods, the difference between contract price and the market price at the due date of delivery.
b. when the buyer purchased goods for re-sate which the setter knew, the difference between the market price and contract price.
c. when delivery is delayed and goods are accepted by buyer measure of damages is the difference between value of goods at the due date of delivery and the actual date of delivery.
